| Official: 2011 decrease may have been due to bank moratorium

Kendall County Circuit Clerk Becky Morganegg delivered her annual report to the County Board at their Jan. 15 meeting.
Morganegg's report highlights 25 different case filings in Kendall County, which is now part of the newly created 23rd Judicial Circuit Court.
"This year there were no big surprises. We were pretty much right on track with what we filed last year," Morganegg told the board before handing out a color-coded copy of the report. "We don't solicit these numbers, they just happen."
One type of case filings inevitably attracts attention, Morganegg said, for those concerned about the status of the housing market.
"I do separate out the foreclosure numbers just because that seems to be a concern, an interest," she said, pointing out that 1,507 foreclosure cases were filed with her office in 2012, an increase of 135 cases from 2011. Foreclosure cases are still more than twice what they were prior to the recession of 2008.
The slight increase in 2012 also comes just two years after a large drop in foreclosures. In 2011, Kendall County saw 1,372 foreclosures filed, a decrease of 455 from 2010 when 1,827 foreclosures were filed.
Morganegg has said previously the large decrease may have been attributed to many major banks declaring a temporary moratorium on foreclosures two years ago.
In 2011, 1,581 homes were sold overall in Kendall County while 1,382 homes fell into foreclosure. In 2008, 5,920 homes were sold and 1,218 homes went into foreclosure.
Six years ago, when Kendall County was still growing, almost 8,000 homes were sold, while just 685 homes went into foreclosure.
DUIs and divorces down slightly from 2011
Morganegg also tracks traffic cases, which make up the bulk of case filings her office handles. Those cases totaled 12,190 last year, down from 12,307 in 2011 and 16,894 in 2010.
The report shows a total of 7,477 cases filed (excluding traffic cases) last year, down slightly from 2011 when 7,636 cases were filed, which continues a decrease from the 8,541 cases filed in 2010.
Divorce and cases of driving under the influence were also down from last year. In 2011, 467 couples filed for divorce compared to 429 last year. DUI cases totaled 287 last year, compared to 290 in 2011.
Criminal felony cases were down from 429 in 2011 to 414 last year. Criminal misdemeanor cases down slightly from 1,231 two years ago to 1,222 in 2012.
Board member Jeff Wehrli pointed out that eminent domain cases have gone up from just five in 2010 to 34 in 2011 and 41 last year. Kendall County State's Attorney Eric Weis responded that it was because the Illinois Department of Transportation began purchasing land to widen Route 47 to four lanes in 2011.
