A retired Oswego School District math teacher who was arrested in June for arranging a meeting with an underage girl at a Wisconsin hotel was sentenced to state prison Monday.
Waukesha County Circuit Court Judge Patrick Haughney sentenced Donald P. McDowell to three years in Wisconsin state prison, and five years probation. McDowell will receive credit for 216 days time served.
As part of McDowell's sentence, during probation he will be required to enter into sexual offender treatment, according to Waukesha County Court records. He will have to maintain full-time employment and/or school, according to the records, and will not be allowed to have unsupervised contact with anyone under the age of 18, and any supervised contacted will have to be approved by a probation officer.
McDowell, 65, pled guilty in November to a charge of attempted second-degree sexual assault of a child, according to county records.
According to a criminal complaint, Waukesha Police Department officers arrested McDowell June 5 in a hotel parking lot in Waukesha, Wis. The arrest followed an investigation during which detectives posed as a father of a 14-year-old girl who chatted online with McDowell.
Following an exchange of photographs - the detective providing a photo of a 14-year-old girl, McDowell sending a photo of himself - the two sides arranged to meet and, according to court records, McDowell's plan was to have sex with the 14-year-old girl.
According to Oswego School District officials, McDowell taught sixth grade at East View Elementary School from 1970 until 1979, when he transferred to Thompson Junior High School, where he taught math until he retired after the 2002-2003 school year.
School district officials said McDowell coached girls' volleyball, basketball and track, and said there were no complaints filed against McDowell while he was an employee of the school district.
The June complaint says a search of McDowell's vehicle following his arrest revealed condoms, a prescription for Viagra, and a sex toy. McDowell also had "a 4 GB data stick, a 1 GB flash drive, a 64 GB IPod, a hotel room key and services folder, a 4 GB flash card, another 4 GB flash card, a 1 GB flash card, a 64 GB Apple iPad and an HP laptop computer," according to the complaint.
The complaint states that police reports "further indicate that an examination of the 4GB thumb drive data stick found in the defendant's vehicle revealed several thousand photographic images. The detective examined them and found that the majority of the images were of very young girls ranging in age from what appeared to be six years old into their teen years."
"The officer also examined the HP brand laptop computer that was in the defendant's possession," the complaint states. "This computer contained over 400,000 graphic files. In a brief review, the detective located thousands of images depicting young girls between the ages of approximately four and teen years in various states of undress and sexually suggestive poses."
The complaint states that McDowell signed a statement with the police in which he acknowledged that he met the officer online.
It reads, "He admitted that he said he preferred younger women, as young as thirteen years old. He claimed that much of the chat was fantasy and not reality, but acknowledged that he agreed to meet 'Tim,' which is the name that the detective was using in his undercover capacity, at a hotel in Wisconsin for the purpose of having sexual contact with 'Tim's' 14-year-old daughter."
